1\. Application of Terms

These Terms of Service (the "Terms") govern the use of the prompt improvement service (the "Service") provided by PromptAI (the "Company") and establish the rights, obligations, and responsibilities between the Company and users.

These Terms apply to all users who use the Service. By using the Service, you are deemed to have agreed to these Terms.
1.3
The Company may modify these Terms as necessary. Any changes to the Terms will be announced through the Service's notice board. Modified Terms will take effect 7 days after the announcement date.
2\. Definition of Service
2.1
The Service provides functionality to automatically analyze and improve prompts used on AI platforms such as ChatGPT, Gemini, Claude, and Perplexity.
2.2
The Service is provided through a Chrome Extension and web application.
2.3
The Company continuously works to improve the quality of the Service and may change the content of the Service without prior notice.
3\. User Obligations
3.1
Users must not engage in the following activities when using the Service:
Violating laws or these Terms
Disrupting the stable operation of the Service
Interfering with other users' use of the Service
Infringing upon the Company's intellectual property rights
Distributing malicious code, viruses, etc.
Unauthorized reproduction, distribution, or modification of the Service
Unauthorized commercial use of the Service
Any other activities deemed inappropriate by the Company
3.2
If a user engages in any of the above activities, the Company may restrict or suspend the user's access to the Service without prior notice.
4\. Intellectual Property Rights
4.1
All content, software, designs, logos, trademarks, etc. included in the Service are protected by the Company's intellectual property rights or third-party intellectual property rights.
4.2
Users may not, without the Company's prior written consent, reproduce, distribute, transmit, display, perform, broadcast, publish, modify, process, sell, rent, create derivative works, or otherwise use any part or all of the Service.
4.3
Users retain rights to improved prompts generated through the Service. However, the Company may use anonymized data for analysis purposes to improve the Service.
5\. Privacy Protection
5.1
The Company strives to protect users' personal information. Matters regarding the collection, use, storage, and destruction of personal information are governed by a separate Privacy Policy.
5.2
The Company uses the OpenAI API to provide the Service, and prompt data may be transmitted to OpenAI. For details, please refer to OpenAI's Privacy Policy.
5.3
The Company does not store users' prompts and only processes them temporarily for improvement purposes.
6\. Service Provision and Changes
6.1
The Company strives to provide the Service 24 hours a day, 365 days a year. However, service may be temporarily suspended due to system maintenance, server expansion or replacement, network instability, etc.
6.2
The Company may change the content of the Service as necessary for quality improvement, technical specification changes, etc.
6.3
If service suspension is necessary, the Company will provide prior notice or notification. However, if prior notice is impossible due to unavoidable circumstances, notification may be provided afterward.
7\. Disclaimer
7.1
The Company is not liable for service interruptions due to force majeure events such as natural disasters, war, service suspension by telecommunications operators, hacking, computer viruses, etc.
7.2
The Company does not guarantee the accuracy, completeness, or usefulness of improved prompts generated through the Service. Users must review and modify improved prompts as necessary before use.
7.3
The Company is not liable for damages caused by errors, delays, or interruptions in the OpenAI API.
7.4
The Company is not liable for any damages incurred by users through use of the Service. However, the Company shall be liable for damages caused by the Company's willful misconduct or gross negligence in accordance with applicable laws.
8\. Usage Limitations
8.1
The Company may limit users' service usage to ensure stable operation of the Service.
8.2
If paid subscription services are introduced in the future, usage limitations may apply according to subscription plans.
9\. Interpretation of Terms and Dispute Resolution
9.1
Matters not specified in these Terms shall be governed by applicable laws and commercial practices.
9.2
Disputes between the Company and users shall be governed by the laws of the Republic of Korea, and the competent court shall be the court having jurisdiction over the Company's headquarters.
9.3
Disputes between the Company and users shall first be resolved through sincere consultation.
10\. Miscellaneous
10.1
These Terms are governed by and interpreted in accordance with the laws of the Republic of Korea.
10.2
If any provision of these Terms is invalid or canceled, the validity of the remaining provisions shall not be affected.
